In a landmark ruling on 23 November 2020, the Court of Appeal overruled the first instance judgment in Re Allied Properties (H.K.) Ltd [2020] HKCFI 2624 and sanctioned a privatisation scheme of arrangement. The Court of Appeal’s reasons will be released in due course. This appears to be the first ever Court of Appeal decision sanctioning a scheme of arrangement.
